| Abstract: | The theory of penal purpose is of great significance in the whole criminal law theory. The purpose of penalty is the logical starting point and the core of the criminal theoretical system; it bears an important influence on the theoretical constructions of penalty and crime, and impacts on the choice of the basic position of criminal theory as well. Therefore, it is of great value not only in theoretical construction but in criminal justice to rethink the systematic position of penal purpose in Chinese criminal law theory. |
