网络表达所致民事侵权在归责时的价值衡量

网络言论、视频和图片可以归结为表达。目前网络表达造成的民事侵权,通常表现为网络暴力即言论,这种侵权在归责时不能简单地套用民事侵权行为的一般法律规定,因为表达权作为一种宪法保护的权利在与具体的被侵犯权利之间要作一个基本价值衡量,并且,表达权在这种价值衡量中处于一种优位。这种优位来源于表达权在法治民主社会所体现的根本性的价值,它不仅是一种立场,同时也是具体个案中权利平衡中的出发点。
