| 摘 要： | 理论上 ,行政行为公定力界限存在“有限公定力说”和“完全公定力说”之争。作者就此问题以新的视角探讨公定力的界限 ,认为应承认行政活动领域的公定力存在 ,否定行政诉讼期间公定力的存在。

| Abstract: | There are theoretically two different theories on the scope of administrative act authority: the "limited authority theory" and the other "absolute authority theory". In this paper the difference is analyzed from a new perspective and the conclusion is made that administrative act authority exists in the administrative process rather than in the administrative litigation. |
