| 摘 要： | 定金法律制度是合同担保制度的一种,其主要作用在于保证主合同债权的顺利实现。笔者对合同定金的性质从其定金的本质作用上进行分析,提出了与传统定金性质不同的看法并对定金适用的条件等基本理论进行分析,对于合同定金在适用时应注意六个方面的事项提出了自己的看法,具有重要的实践意义。

| Abstract: | The legal system of deposit is one of contract's guarantee systems;its main function is to grantee the realization of the primary contract.On analyzing the nature and function of deposit,the writer gives his own opinions which are different from the traditional.At the same time,the writer analyses the suitable conditions of contract's deposit.Views posed on six items which we should be caution when applying make the paper quite significant. |
