完善我国《反倾销条例》的反规避条款

为了适应我国加入WTO的新形势以及反倾销实际工作的需要并履行我们在入世中的承诺,2001年10月31日国务院通过了<中华人民共和国反倾销条例>自2002年1月1日起施行.但该条例对反倾销规避仅作了一条原则性的规定,不利于反规避条款的正确适用,通过对欧盟反规避条款的分析和评价,提出了完善我国反规避条款的几点建议.

Perfecting the anti-circumvetion clause in China

To meet the needs of our countrv's entering WTO, anti - dumping practice and fulfilling its commitments made when entering WTO, .the state council passed, on Dec 31, 2001, the Regulation by the peoples Republic of China on anti - dumping which was to be put into practice on Jan Ist 2002. The above regulation, however, provides only one clause in priniciple regarding anti - dumping circumvetion, which hinder the application of anti - circumvetion clauses. In the thesis analysis and assessment are made on the anti - circumuetion legislation by the Europe-an Union, and proposals are provided regarding the perfection of anti - circumvetion legislation in China.
