浅谈反垄断诉讼的原告资格问题

反垄断诉讼是公益诉讼,具有公益诉讼的一般特点但又具有其自身特殊性。现行立法条件下对于反垄断诉讼的原告资格有很多限制,有其不合理之处,应扩大反垄断诉讼的原告范围,并出台一些配套措施。

The Research on Plaintiff Qualification in the Antitrust Litigation

Antitrust litigation belongs to public interest litigation.It has the generality of public interest litigation and has its own particularity.There are many limitations to the plaintiff qualification of Antitrust litigation under the circumstances of existing legislation.There is something unreasonable which need to be modified.We should extend the scope of the plaintiff in antitrust litigation and establish some measures to change the present situation.
