| 摘 要： | 对人类的规范、法律、制度的形成和发展的研究是人类学的重要话题,对当今社会法律的研究也有一定的借鉴意义.通过对马林诺夫斯基的《原始社会的犯罪与习俗》这本重要的法律人类学著作的解读来探析原始社会的"法律",对"什么是法律"进行梳理,并结合现实社会的法律状况,可以使人对人类法律发展的进程有一个认识.

| Abstract: | The study of the formation and development of human standards,laws and systems is an important subject,which also benefits the study of the contemporary social laws.The "law"of the primitive society is explored by decoding Malinowski's "The Crimes and Conventions of the Primitive Society",the classical work in anthropology of laws.Meanwhile,analyzing what is law and combining the status of law in the real society can make people know about the process of human laws. |
