中国语境下民意与死刑适用的互动

民意在死刑案件审判中的实际作用逐渐受到关注,然而目前的研究集中在对民意本身的分析与批判,忽视了中国语境下民意的独特内涵与影响,在消除民意对死刑案件审判不合理影响的手段上缺乏可操作性。在中国语境下,民意与死刑案件审判处于互动关系之中,其产生、作用和影响与西方语境下的民意有很大的区别。民意既有有益的一面,也存在负面影响,严格遵循司法程序应该是引导民意的最佳途径。

Interaction between Public Will and Death Penalty in Chinese Context

More attention has been paid to the actual effect of public will on death penalty. However, the present research concentrates on the analysis and criticism of public will itself and neglects the unique signification and influence in Chinese context. As a result, it is not pragmatic to eliminate the negative effect of the public will on death penalty. Actually, interaction between public will and death penalty in China is different from that of western countries in terms of its occurrence, function and impact. Although public will have some positive or negative effects on death penalty, the best way to guiding the former is to strictly follow the judicial procedure.
