知识产权司法审判的商事化改革

我国知识产权审判应当在技术化改革基础上进行商事化改革，体现知识产权实体法的商事性质，凸显当事人知识产权创造、运用活动及知识产权诉讼行为的营利属性。知识产权司法审判理念要相对区隔于普通民事审判，并在保障营利与兼顾公平、市场导向与利益平衡、尊重意思自治与减少交易成本、保障交易安全和促进价值实现等方面进行商事化转型。在审判机制方面，要以商事法官或商事调查官为重点推进组织机构建设，引入法庭之友，并解决举证责任、诉讼利益分配及过错行为加重责任等问题，体现知识产权审判商事化改革取向。

Commercialization Reform of Intellectual Property Judicial Trial

The intellectual property trial in our country should undertake commercial reform being based on the technological reform, which reflects the commercial nature of the substantive law of intellectual property and highlights the profitability of the parties'' intellectual property creation, application activities and intellectual property litigation. The concept of intellectual property judicial trial should be relatively different from the common civil trial, and to be commercialized in such aspects as ensuring both profit and fairness, market orientation and balance of interests, respecting autonomy of the will and reducing transaction costs, ensuring transaction safety and promoting value realization. In terms of judicial mechanism, we should focus on commercial judges or commercial investigators to promote the construction of organizational structure, introduce amicus curiae, and solve problems such as burden of proof, distribution of litigation interests and aggravation of liability for wrongful acts, so as to reflect the orientation of commercial reform of intellectual property trial.
