“公共利益”的解释困境及其突围

“公共利益”的实体解释理论无法界定“不特定多数”这个概念,对“利益”的内涵也无法形成共识。“公共利益”的程序解释理论将公共利益的解释问题转化为“谁来决定公共利益”的问题,实质上将公共利益的解释问题虚化了。可能的突围方案是对公共利益的反向解释,即通过逐步清理公共利益的边界,将公共利益的“假冒形态”逐出公共利益的范围,这样就可以避免在公共利益判断中走过多的弯路。

Predicament in the Interpretation of Public Interest and the Way Out

The substantial interpretation of public interest can neither define the non-qualified majority,nor formulate common understanding on the essence of interest.The procedural interpretation of public interest transforms the problem of how to interpret public interest to the problem of who decide public interest,and thus evades the problem.We may resolve this problem through the reversed interpretation of public interest,which means clearing the boundary of public interest gradually,and driving the false model of public interest out of the range of genuine public interest.Thus we can reduce difficulties in deciding the public interest.
