| 摘 要： | 真实性是证据的核心内容,人证是以人的语言陈述形式表现证据事实的各种证据,由于其具有动态反映性、虚假可能性、不稳定性、难以收集等特点,人证的伪证频率很高,使得法官对人证不敢轻易的采信。如何判断人证的真实性,司法实践中引进了测谎,笔者认为,人证的真实性不能外化为测谎。

| Abstract: | Factuality is the core of evidence. Witness is to illuminate various evidences by means of statements. For its dynamic reflection , false possibility instability, difficulty in collecting , and the likelihood of false witness, judges do not adopt witnesses' words easily. To screen the factuality lie detection is introduced in the judicial practice. The writer believes that witness' factuality can't be replaced by lie detection. |
