| 摘 要： | 关于“揭发他人犯罪”：第一，“他人犯罪”不应以共同犯罪来划分，而应以证据要求来划分；第二，其中的“犯罪”在刑法和刑诉法上均具有多义性。对于“花钱买立功线索”问题，只要行为不存在违法情形，可以认定为立功。立功时间应为犯罪后而非到案后。

| Abstract: | On exposing other crimes, its judgment standard is the demand of evidence, not joint offense. Moreover, offense has plural meanings in criminal law and criminal procedure law. Clues to criminal cases by spending money can be considered as performing meritorious services unless they are illegal. Only after the crime could he be take to perform meritorious services. |
