| 摘 要： | 为了考察中国宗法社会制度演进路径,依托博弈论分析工具,认为基层宗族社会的重复博弈自发生成礼,并在礼的指导下进一步形成哈耶克式的礼治秩序;源于维持宗法社会国家层面上的合作格局的需求,国家通过制定和实施法,创造了在法约束下的人造秩序。礼法并举构成了中国宗法社会的制度框架。
