| 摘 要： | 现代性代表一种精神和理念,它不同于现代化和现代性观念。法治现代性不能因法治现代化而蒙尘,也不应被法治现代性观念所遮蔽。法治就是在现代性视阈下不断反思的法治现代性。

| Abstract: | Modernity,which represents a spirit and idea,is knows from modernization and modernistic conception.The modernity of rule of law should not be incurred by modernization,and be shade by modernistic conception as well.The rule of law is a ceaselessly reflective modernistic rule of law under the view of modernity. |
