| 摘 要： | 侵占遗忘物是侵占罪的特殊类型。遗忘物是持有者因疏忽未带走而遗留在他人能有效管理之场所的财物。第三者非法取得已置于他人管理范围的遗忘物,不能构成侵占罪,但可能构成盗窃罪。

| Abstract: | The misappropriation of forgotten article is a special form of misappropriation crime.Forgotten articles are those properties within other people's control,for it is left over by its legal possessor with negligence.A third party illegally gaining forgotten articles which is already within someone's management scope,can't constitute misappropriation crime.However,it may constitute theft offence. |
