新农保推进中的法律保障机制探析

当前我国已进入老龄化社会,进入老龄的人口近六成分布在农村,我国亟待建立新型农村社会养老保险法律制度。新农保试点已经展开,但在实施中存在对新农保制度缺乏法律支持;定额制筹资机制不合理;政府财政补贴力度不大;养老金支付水平低;基金保值增值难;监督机制不力等问题。因此,应制定法律层次高的农村社会养老保险法;实行动态的可调整的缴费机制;加大中央政府财政补贴力度;建立支付待遇调整机制;拓宽基金投资渠道;健全社保经办机构,建设信息网络系统;加大监督力度等法律保障措施,以保证新农保制度的顺利实施。

On the Legal System of the New Rural Social Endowment Insurance

Now our country has entered aging society,60% of the old live in the rural areas.So it is time to establish the legal system of the new rural social endowment insurance.The new rural social endowment insurance system has been built up at some experimental areas.However,there are some problems during the practice,such as: lack of legal stipulations;unreasonable fix payment amount;little government subsidies;lower old-age pension;difficulty of increment.Based on these problems,I proposed that our country should carry on the dynamic payment system,improve government subsidies,establish the adjustable pension payment,widen pension fund investment,set up the information network data,strength the supervision system and so on.
