| 摘 要： | 商业秘密权的性质是在商业秘密法律保护中亟待解决的一个关键性问题。学者们认为商业秘密权或是财产权、人格权、企业权、知识产权,甚至是一种全新的权利类型。从周延的保护商业秘密权的本质出发,运用法经济学有关产权界定和法理中有关民事权利分类的理论来分析,可以发现,将商业秘密权界定为一种新兴的知识产权是恰当的。
