论卧底侦查程序法原则

运用理论分析、比较的方法将法治国的一些重大原则运用于卧底侦查,试图实现对卧底侦查的程序性控制。分析认为,法律保留原则、比例原则、最后手段原则、对付重大犯罪原则、司法令状原则及个案正义原则可从事前、事中与事后角度实现对卧底侦查的静态与动态的双重控制。

Principles of procedural law for undercover investigation

This paper adopts the theoretical analysis and the comparative methods to the examination of some important law rules in the undercover investigation,in an attempt to achieve the procedural control of the undercover investigation.The author thinks that the legal reservation principles,the proportionality principles,the last resort principles,the principles of dealing with major crimes,judicial writ principles and case justice principles can all be adopted to achieve the dual control of undercover investigation in their static and dynamic state prior to,during and afterward cases.
