| 摘 要： | 合同自由原则历经演变,虽然多有变化甚至受到种种限制,但其并未真正"衰落",对合同自由的限制其实是对其真义的恢复.我国合同法虽对合同自由原则作了规制但仍有问题存在.因此,应将彻底贯彻合同自由和防止合同自由绝对化相结合的原则,不断完善合同法律制度.

| Abstract: | This article begins with the history development of the principle of the freedom of contract. Then it refutes the claim that the principle of the freedom of contract has degenerated.Moreover,the various limits on contract freedom are the recovery of the genuine intension of its principle .Based on this point of view, it makes a thorough analysis of the status of this principle in our contract law. In addition,the authors point out that we should,on one hand , make a good use of the principle of the freedom of contract, and on the other hand , we are supposed to try our best to avoid achieving the principle in an absolute way. |
