| 摘 要： | 协议保护机制具有契约性、参与性、有效性、针对性、经济性以及可预测性的特点,受到环保基金、非政府组织的青睐,对于社会公众参与环境保护具有重要意义.其他国家的立法和实践已显示出该机制的灵活性,我国法律也为实施协议保护机制提供了一定的制度资源.为了更好地实施协议保护机制,应当根据土地的性质选择相应的模式,加强与当地社区和政府的合作,合理约定补偿,并确定合理的保护标准和指南.
