土地承包经营权的法益分析

土地承包经营权是我国农村实行家庭联产承包责任制之后而产生的一项关于土地的权利,这一权利诞生以后,为农村的经济发展起到了极大的推动作用。本文在对土地承包经营权的性质、经济内涵及其在实现的现实性上所存在的问题进行阐述的基础上,对土地承包经营权的法益进行了分析,指出了在法律上明确土地承包经营权的性质及其意义所在。
