关于完善我国环境资源保护法的立法建议

随着环境公害的日益严重，世界各国纷纷加强了环境立法和环境法制建设。我国自上个世纪80年代以来，逐步强化环境保护的立法和执法工作，但不容忽视的是环境污染形势依然很严峻，造成这种境况的主要原因是随着时代的发展进步，我国《环境保护法》立法目的滞后、法律地位较低等问题越来越凸显．本文从确立环境权、立法基本原则、完善相关制度和理顺执法体系等方面进行深入法律思考，并对修改环境保护法提出完善建议。

Proposals on Perfecting China's Law on Protection of Environmentd Resources

With the increasing environmental pollution, the world has strengthened up lawmaking on protecting the environment. Despite China's continuous efforts since the 1980s to tighten lawmaking and law enforcement on the environmental protection, there is no overlooking of the fact that pollution in the country remains the most serious. What is mainly to blame for the current situation is outdated goals of law-making on Environmental Protection and its inferior status. The paper puts forward suggestions on perfecting the law, based on the insights into the establishment of the environmental rights, basic principles of making the law, improvement of relevant systems and coordination of law enforcement mechanisms.
