刍论GPA视角下我国政府采购法律制度的完善

《政府采购法》的颁布施行,填补了我国政府采购领域立法的空白,有力地规范了政府采购行为。但与GPA规定相比,我国政府采购法律制度还存在诸多问题与不足。在中国加入GPA的关键时期,应该从国情出发,根据GPA规定,协调《政府采购法》与《招标投标法》的关系、完善《政府采购法》的基本原则、明晰政府采购的适用范围、规范政府采购方式和程序、完善政府采购的质疑和投诉程序、健全政府采购的监督机制,从而完善我国政府采购法律体系。

Discussion on the Perfection of Chinese Government Procurement Legal System from Perspective of the GPA

Promulgation of the Government Procurement Law in China filled the legislative gaps in the field of government procurement,and regulated the behavior of government procurement.But with the GPA rules,Chinese government procurement legal system still has many problems and shortcomings.In order to improve Chinese legal system of government procurement,we＇ll coordinate relationship between Government Procurement Law and the Bidding Law,improve the basic principles of Government Procurement Law,clear the scope of government procurement,standardize the methods and procedures for government procurement,improve the government procurement questions and complaints procedures,and improve the supervisory system of government procurement in the critical period of Chinese accession to the GPA.
