| 摘 要： | 我国现行合同法确立了全面履行的原则,但基于合同自由、公平正义的要求,合同法还应有实际履行优先原则和实质履行原则作为补充。三项原则结合起来才能较好地解决合同司法实践中出现的问题。

| Abstract: | The paper discusses the principle of comprehensive perfonnance established in the prevailing contract law which should be guided by the value concept of integrity. And the possibility of preferential principle of actual performance and the principle of essential performance, which may be established in future contract legislation and judicature on the basis of contract freedom,fairness and justice,has been analyzed in this article. |
