阶级分析:一种法学方法的死亡与再生

近年来,在法学方法论的视野中,传统的阶级分析方法地位尴尬、处境艰难,最主要的原因在于,传统的阶级分析方法过多地凸显了法律的阶级对抗性,从而为20世纪50至70年代的阶级斗争和社会动荡起到了推波助澜的作用,那个时代的中国法理学也因此成为受人诟病的阶级斗争法学。然而,阶级分析作为一种法学方法,不仅可以对应于阶级斗争,也可以为阶级合作、政治民主、社会和谐提供方法论上的支持,并促使中国法理学从阶级斗争法学转化成为阶级合作法学。当然,要实现阶级分析方法的这种转向,要使法学服务于阶级合作与社会和谐,必须对阶级的概念与阶级分析方法进行重构。
