加强反洗钱情报机制的法制建设——以我国金融情报机构为例

情报信息工作的重要性已日益为反洗钱工作实践所证明。源于西方国家反洗钱实践的金融情报机构，从诞生之日起便以相应的法律规定作为其独立履行职责的保障。与国际标准相比，我国金融情报机构存在着法律地位未予突出、法定职权保障不足、法律属性未能厘清、报告范围较为狭窄等法律问题。应借鉴金融情报机构国际立法的有益经验，从金融情报机构自身建设及以特定非金融行业促进金融情报机构建设两方面着手，加强我国金融情报机构法制建设。

Reinforcement of the Legal Construction of Anti-money Laundering Intelligence Mechanism---A Case Study of the Financial Intelligence Organizations of China

The importance of the intelligence information work has been increasingly proved by anti-money laundering work.The financial intelligence organizations established for the purpose of anti-money laundering prac-tice originated from the western countries has been safeguarded starting from the date of their birth by the corre-sponding law for their independent duties and functions.Compared with the international standards, the Chinese fi-nancial intelligence agencies are confronted with problems such as the lack of protuberance of the legal status, the inadequate protection of the legal authority, ambiguity of the legal attribute, and the limited publicity.To address these problems, we should draw the international lessons from the financial intelligence agencies, and strengthen the legal construction of the legal organizations by focusing on the internal legal construction and construction of the fi-nancial intelligence agencies promoted by the specific non-financial organizations.
