关于正当当事人的若干思考

当事人与正当当事人是外延不同的两个概念,作为诉讼主体的当事人应是案件的正当当事人(适格当事人,而程序上的当事人由于未必与诉讼标的有利害关系而不一定能成为有诉讼主体资格的正当当事人。正当当事人与程序当事人的判断标准是对诉争的实体法律关系是否有一定的实体利益关系,并在这种判断标准下对正当当事人的种类作了归纳。应允许一定条件下依诉的利益成为正当当事人,以扩大正当当事人制度的保护范围:对正当当事人的审查应在诉讼中进行,以维护程序的实质作用;正当当事人制度有利于诉讼经济的目标。

Thoughts on the valid client

The client and the valid client are different concepts in extension.The client as the proceeding corpus should be the valid client (qualified client)of the case,however,the procedual client may not be the valid client with the qualification as the proceeding corpus,for it's lack of substantive relationship with the preceding res.Whether it has some substantive relationship of interest in the litigation dispute of entities' legal relationship or not,is the very criterion to tell the valid client from the procedual client,by which the sorts of the valid client are sumraerized.As valid client system is concerned,the author believes that the procedual client should be allowed to be the valid client under some conditition of the versus-interest,so as to extend the protection scope provided by the valid client system.The author also believes that the verification on the client should be made during the procedure,in order to protect the actual action of the procedure,and the valid client system wil be useful to achieve the target of efficient procedure.
