传统法律心态问题探究

传统社会形成的人们对法律问题的政治性心态、调和性心态和道德性心态构成法律心态的典型形式。这些与"一切以法律为唯一准则"的现代法治理念形成冲突,在对传统法律心态进行理性反思的基础上,在肯定其存在的历史必然性的同时,批判其中的不合理成分,用现代法治理念对传统法律心态进行改造,以形成政治问题法制化,利益主体确定化,道德问题法律化的现代法律心态。

Analysis of the Psychology under Traditional Law

Political psychology, conciliating psychology and moral psychology which have been formed in traditional society construct the typical states of psychology under traditional law, but they all conflict with modern legal ideas ——"law is the only standard for all". On the basis of the reflections on traditional legal psychology, its irrational parts should be criticized, when it is affirmed that its existence is of historical inevitability. By making use of modern legal ideas, the psychology under traditional law is to be reformed, so as to legal-systemize the political problems, make certain the beneficial body and legalize the moral problems.
