论学生伤害事故中学校责任的认定

近年来，学生伤害事故及其引发的法律纠纷越来越多，日益成为困扰学校工作的严重问题。本文在对学校与学生之间法律关系进行论述的基础上，结合相关法律规定，提出学生伤害事故适用过错责任原则，根据过错构成情况的不同，学校责任认定应采用客观过错标准。

Identifying School Responsibility on Students" Injury

In recent years,more and more student's injury cases and their related legal disputes have energed and have increasingly become a serious problem troubling schools.On the basis of legal relations between schools and students,and relevant legal provisions,this article proposes that school is the responsibility of a fault liability and presents the criteria for judging schools fault,meanwhile,it analgzes the way a school assumes the responsibility under different conditions.
