检察机关羁押必要性审查制度的解构

新（《刑事诉讼法》第93条首次确立了检察机关的羁押必要性审查制度，这是我国现行逮捕羁押制度的一项重大改革，是强化检察监督的重要举措。对于强化检察机关的法律监督职能，切实保护犯罪嫌疑人、被告人的合法权益具有非常重要的意义。但是刑诉法对这一制度规定得过于笼统、原则，缺乏可操作性，检察机关在具体的侦查监督工作中如何把握、实施该项工作制度是一个难点。因此，笔者试图结合刑事诉讼法修改的精神和检察实际工作，探究这一制度入法的背景及理论、实践基础，进一步探讨羁押必要性审查制度的构建，旨在使这项制度能最大程度地保障犯罪嫌疑人的合法权益。

Deconstructing the Necessity of Detain Censorship in Procuratorial Organ

New ＂criminal procedural law＂ article 93 established the necessity custody censorship of procuratorial organ for the first time, this is a significant reform in the system of our country＇s current arrest of detention, is the important measure of strengthening procuratorial supervision. For strengthening legal supervision function of procuratorial organs, to protect the legitimate rights and interests of the criminal suspect or defendant has very important significance. But points in the system too general and principle, the lack of maneuverability, the procuratorial organs in how to grasp the specific investigation supervision work, the implementation of the work system is a difficulty. Therefore, the author tries to combine the spirit of the criminal procedure law modification and procuratorial practice, to explore the background of the system into the law and the theory, practice, further explore the building of detention necessity of censorship, aims to make the system to protect the legitimate rights and interests of criminal suspects to the greatest extent.
