| 摘 要： | 在现实生活中,人身保险合同的订立和理赔都需要对人身保险的保险利益作出准确的理解,在运用人身保险利益制度时,我们需要它有一个明确的归属。人身保险理论是一种有害的形式主义理论,制约了人寿业的发展。立足于道德危险防范的综合性整合,应摒弃人身保险的利益理论,坚持绝对的同意原则。
