| 摘 要： | 法庭询问是庭审调查的核心,对诱导性询问的法律规则直接关系到刑事庭审中司法公正、效率等多元价值的实现。在必须正确认识诱导性询问规则概念性质和作用分析的基础上,对诱导性规则进行了价值评析。对我国诱导性询问及规则作了反思。并提出了完善我国刑事庭审中诱导性规则的若干构想。

| Abstract: | Inquiry in the courtroom is the core of in-court investigation. Thus, the legal principle of prohibiting inductive inquire directly affects the realization of the course of justice, the efficiency and so on. The paper based on a clear understanding of the essence of the rule of prohibiting inductive inquire and an analysis of the role it plays, it evaluates the rule and present a deeper thinking over our inductive inquire and the rule, and proposes some suggestions on improving the principles in criminal court. |
