| 摘 要： | 在大陆法系,物权人对无权占有的自力回复限制于占有物自力取回权和自助行为,上述私力的行使有严格的条件限制,并且不是基于物权本身的效力,不利于物权人权利的实现.因此有待于对物权追及效力重新认识,并承认基于该效力的自力取回权.
