| 摘 要： | 《国家赔偿法》第三十五条的规定,使精神损害赔偿数额的确定在类案中千差万别,严重影响司法公信力。为促进适法统一,建议完善司法赔偿制度中的精神损害赔偿标准,通过＂三步法＂确定精神损害抚慰金：根据＂精神损害抚慰金赔偿表＂确定赔偿区间,参照酌定考量因素厘定赔偿档次,最后由法官裁量决定具体赔偿数额。

| Abstract: | The rigid provision in the Article 35 of the Law on State Compensation＇caused conform- ityof the amount of compensation in mental injury diversified and severely affected judicial credibility. To promote legal unification, we suggest to improve the standard of mental injury in the judicial compensation system and via three steps to establish consolation compensation concerning mental injury; In accordance with the schedule of consolation compensation concerning mental injury to confirm compensation section and justified categories by reference and eventually allowing judges to decide on specific amount of compensation. |
