能动司法与司法改革

回到事实本身是澄清能动司法相关是非的基础和前提.能动司法既不是新发明,也不是舶来品,中国当下的能动司法是司法改革政策调整后人民司法传统复兴的产物.能动司法强调的是司法中人的作用,其本质上是一种贤人司法.最理想的社会治理图景是在拥有法治的同时也拥有贤能的司法者,故作为贤人司法的能动司法具有普世的价值和广阔的发展前景.中国司法改革的目标和使命是建立和健全一套符合法治精神的现代司法制度,能动只是中国司法改革过程中应当固守的一种道德优势,如果在还没有实现法治之时就将主要精力用于追求司法者的贤能上则是改革的错位和跑题.

Judicial Activism and Judicial Reform in China

To clarify the basis and premise of related debates, we need to go back to the fact itself. Judi- cial activism is neither a new invention nor an exotic term, for current judicial activism in China is the product of the revival of the tradition of peoples judiciary after the adjustments of the judicial reform policy. Attaching importance to the role of judicial persons, judicial activism, by its very nature, is the judiciary of sages. The best ideal social governance is to rule by law and at the same time to rule by judicial sages. So the judicial ac- tivism under the rule of judicial sage shall share universal values and a broad developmental prospect. The goal and mission of China＇ s judicial reform is to establish and improve a modern judicial system in line with the spir- it of the modern rule of law, in which activism shall be abided by as a moral advantage in the process of judicial reform. Hence, if the main energy is used for the pursuit of justice by the judiciary sages before the idea of rule of law is achieved, it will lead to dislocation and irrelevance of the judicial reform.
