| 摘 要： | 近年来，欧盟对私法的统一铸造了一部新的欧洲法律文化，其国际性和商业性使其具有成为“现代商人法”的潜在力量。那么，欧盟私法统一与现代商人法之间究竞存在着何种联系与区分。现从现代商人法的起源、欧盟私法统一的动力以及对国际间商事条约的参照，来剖析欧盟私法统一与现代商人法之间的辩证关系。

| Abstract: | In recent years, the EU has created a new European legal culture by unifying its private laws. Its international and commercial features have made it potential for ＂modern merchant law＂. Then, what is the asso- ciation and distinction between the unified EU private laws and the modern merchant law. This paper attempts to analyze the dialectical relationship between the two laws by referring to the origin of modern merchant law, the motive for the unification of EU private laws and the international commercial treaties. |
