法人类学研究的当代课题

法人类学透过生动的故事指出法律是地方性知识。习俗不仅是文化的载体,还建立了行之有效的秩序。基于法观念和法秩序的非中心化现象,法人类学将文化特殊论和地方例外论嵌入跨文化的法治图景之中。然而,人类活动突破地理的隔离后,文化的交流和竞争对地方性知识形成强大挤压,文化相对论和地方例外论不免受到质疑。文化平等反过来支持文化排斥、文化的群体认知威胁个体选择、地方化的争议解决机制挑战程序正义、法律多元论挑战普遍价值等当代课题日渐突出,法人类学应当予以密切关注和积极回应。

The Contemporary Issues in Legal Anthropology Studies

In this article, the author thinks that legal anthropology suggests that law is local knowledge through the vivid stories. Local customs is regarded as the embodiment of local cultures and effective order. Based on the idea of non-centralized legal institutions, legal anthropology emphasizes to implant cultural particularism and local exceptionalism into legal prospect. However, because of breaking through the geographical isolation, cultural communication and competition formed powerful extrusion, which leads to doubt concerning cultural relativism and local exceptionalism. In turn, the cultural equality supports the cultural repulsion, the cultural collective cognition threatens the individual selection, the mechanism of localized dispute resolution challenges the procedure justice and the legal pluralism challenges the universal values, all of which show that contemporary issues become more and more intractable. It is argued that legal anthropologists should pay more attention to contemporary issues.
