关于互联网上个人信息保护立法的思考

在互联网时代 ,网上个人信息被滥用的风险加大 ,这不仅不符合保护个人权益的法制精神 ,而且直接阻碍着电子商务的发展 ,因此 ,目前世界各国都在加快个人信息保护的立法工作。由于我国的法治化进程和网络发展时间相对较短 ,因而在网络个人信息保护的立法方面仍是空白。我们可以参照欧美其他国家的有关法律 ,结合我国的实际 ,制订出切实可行的个人信息保护法律。

Reflection on the Legislation

With the development of Internet,personal information can be greatly misused over the Internet. This is notin keeping with the spiritof law to protectprivacy right. It hinders the development of e-commerce. So more and more countries are working on the Privacy Information Protect Law. Because the time for the legalization process and the network developmentisrelatively shortin ourcountry,the legislation about Internetpriva- cy protection is still a vacancy in China.We can use the corresponding law of Europe and America as reference to work outthe Internet Privacy Protect Law thatsuits the situation of China.
