配偶权若干问题研究

在现代社会背景下考察配偶权,应当注意近代以来自由、平等和妇女解放等理念对法律制度改造之力,摆脱配偶权为支配权的传统看法,将配偶权定性为配偶双方平等享有的关于身份利益的请求权,任何一方仅得请求对方作为或不作为,即其内容包括同居请求权和贞操保持请求权,以及对应的同居义务和忠实义务。配偶权同时具有对人效力和对世效力;由于过错侵害配偶权的,应当依法承担法律责任。
