| 摘 要： | 依据我国刑法的明文规定和从实际效果出发,对于紧急避险不能实行正当防卫;对于故意自行招致的危险,不分情况地对其主张紧急避险肯定说或否定说是不合理的;紧急避险规定中的“不得已”,应指没有其他援救途径的状态;在“生命对生命”的情况下,也可以成立紧急避险。
