论我国《著作权法》限制制度的改进——基于权利封闭性与限制开放性原则的检讨

由于著作权限制是针对具体权利的限制,著作权权利制度的封闭性是限制的可能前提,而限制的开放性使伴随社会发展所需要的新的限制成为可能,因此权利的封闭性与限制的开放性是著作权限制制度的基础性构建原则。并从此衍生出有权利必有限制及其限制的不可排除性原则。应该以此原则对我国《著作权法》的限制制度进行检讨,进而完善其制度构建。
