| 摘 要： | 行政立法评估是我国改善行政立法质量的重要制度。评估是事实认定与价值判断的主客观相结合的过程,因此主体制度的完善对立法评估制度具有重要意义。当前各地实践中对立法评估主体的规定各不相同,且各主体权利、义务也未得到明确和保障,因此不利于我国行政立法评估制度目的的实现。只有明确各主体地位及其在评估程序中的权利、义务,才能体现该制度的民主性和科学性,并促进我国行政立法评估制度的进一步发展。
