| 摘 要： | 同质料性是德国法院在一系列判例中确立的,用来处理违约责任和侵权责任竞合问题时所采用的一种特殊原则。在特定情形下,法院可以依据其对于物的损害赔偿和物本身因最初就有的缺陷而导致的价值降低之间是否具有同质料性,来确定案件所应该适用的法律,决定案件属于侵权还是违约。我国在处理类似疑难案件方面可以借鉴该制度。

| Abstract: | The principle of stoffgleichheit is established for the liability concurrence by the court in a suite of judicial precedent in Germany.The court could decide which law would be used,the tort or contracts,through analyzing whether stoffgleichheit has the damage for material and the value reduced caused by its own primary deficiency.We can use the experiences for reference in dealing with such difficult cases. |
