| 摘 要： | 既判事实的预决力在效力内容上包括“一致性”和“确定性”。预决力的强弱主要基于既判事实所属诉讼类型对证明标准的要求，而证明标准体现了案件事实与客观真实的远近关系。“相对的预决力”在大多数情况下应当得到适用，但在一些案件中也存在“绝对的预决力”。预决力问题应当成为证据法典的重要内容。

| Abstract: | The pre-determined force （ PDF ）of the adjudged facts entails＂consistency＂ and ＂definiteness＂. How strong the force is depends on the requirements of the type of adjudged facts on criterion of verification, whereas criterion of verification embodies the extent to which the proof and the facts of the case are connected with each other, In most cases, the relative PDF should be applicable, while in some cases absolute PDF exists as well. The issue of PDF ought to be the important content in the law of evidence. |
