中国环境执法的障碍与破解

当前,中国环境执法面临新的背景,环境执法的障碍也有新的变化.环境立法缺失情况严重,环境执法依据不足;环境执法体制缺陷明显,执法效益低下;环境执法机制不科学;环境执法地方性差异明显;环境执法监督机制不完善等构成了中国环境执法的主要障碍.应采取制定基本法层面的环境恢复和再生立法;弥补专项环境污染防治立法的空白;提升环境立法质量,注重立法的可操作性;健全环境执法机构,提高环境执法能力;加强环境法律监督,充分发挥环境监督的作用;配套环境执法的外部制度,降低环境执法成本等措施,破解当前环境执法的障碍.
