| 摘 要： | 《消费者权益保护法》第55条第一款中"欺诈"的定性与认定是惩罚性赔偿制度的重要适用前提。理解欺诈的基础是明确这个概念在经济法与民法的两个角度下的责任性质。而在此之上,探索"欺诈"具体适用时所要遵循的民法原则和经济法倾向,能够重新理解"欺诈"在新消法中的内涵。
