我国无线电管理立法回顾与展望

我国无线电管理立法经历了三个阶段，总体上曲折发展，成绩斐然。改革开放后，无线电管理立法指导思想从“少设、严管”调整到为经济建设服务后，无线电管理立法稳步发展，并逐步形成了无线电管理法规体系，无线电管理立法呈现出三大特点。针对无线电管理立法中存在的不足，从四个方面提出了完善我国无线电管理立法工作的对策建议：①尽快完成《无线电管理条例》修订工作；②制定《无线电管制规定》实施细则；③出台关于扰乱无线电通讯管理秩序罪的司法解释；④加紧修订无线电管理部门规章及规范性文件。

Review and Prospect on Radio Regulation Legislation of China

Radio regulation legislation has gone through three stages, developing by twists and turns and achie-ving success on whole. Legislative guidelines on radio regulation were adjusted to economic construction from“less set, strict control” after the reform and opening up. Radio regulation legislation develops steadily, and gradually forms a radio regulation legal system. Radio regulation legislation presents three characteristics. Since the hysteresis and legislative defects on radio regulation, suggestions and new measures are proposed to perfect radio regulation legislation from four aspects, that is,“Radio Regulation” is amended, rules of implementation for “Radio Control Regulation” is made, the judicial interpretation of the crime of disturbing the order of radio communication is made, and departmental rules and regulatory documents for radio regulations are revised as soon as possible.
