论人与自然和谐的环境观--以环境法的理念转换为视角

本文以和谐社会的环境法观念转换为视角,通过分析人类中心主义环境观的不合目的性及其观念根源,提出人与自然和谐的环境观,进而论证并重新定义了环境概念.本文提出环境乃是生命体之间及其与非生命体之间基于生存的安全与持续而形成的和谐关系状态.人的环境是人类与所有的生命体以及非生命体之间基于生存的安全与持续而建立的和谐关系状态.在此基础上,本文尝试提出了人与自然和谐观念下的环境法律分层问题.

A View of the Environment in Which Man and Nature Exist in Harmony

From the perspective of the changed concept of environmental law in a harmonious society,this paper analyses the origin of man-based environmental view,and its incompatibility with the aim,puts forward a view of environment in which man and nature exist in harmony,and then redefines the concept of environment.On this basis,it attempts to raise the issue of levels of environmental law in the context of harmony between man and nature.
