论国际市场经济的调节及其法律规制

由于市场调节和国家调节两种机制都存在局限性,需要一种新的国际调节机制来应对因全球化而形成的国际市场经济。这种新的国际经济调节又需要相应的法律来规制和保障其实现。基于发达资本主义国家主导全球化并导致国际间利益两极分化的事实,这种国际经济调节规制法所遵循的价值理念,必然以企业自由、公平竞争、市场法治、经济安全和经济效率为优先,而以主体平等、实质公平和社会公正等作为次要的价值目标。

International Market Economy's Regulation and Its Legislative Regimes

The international market economy needs a new kind of regulation mechanism to cope with defects of market regulation and limitations of state economic regulation.The new international regulation mechanism also needs the relative laws' regimes and preserving.According to the fact of interest division caused by the economic globalization,the value of relative laws should be that considering the freedom of enterprises,the fairness of competition,the journalism of the market,and the economic security and efficiency as the preference;what is more,the equality of the subjects,the substantial fairness,and the social justice will be seemed as the supplement.
