姓氏文化与古代法律

中国古代社会宗法制度盛行 ,宗族组织在社会生活中发挥着较大的作用 ,姓氏作为宗族血缘的符号和标志 ,人们赋予其很多的文化意义。这种文化对古代法律也产生过较大的影响。本文就传统姓氏文化与古代的家族制度、与古代的婚姻制度、与立后收养制度的关系进行了初步的探讨。

Culture of Family Name and Laws in the Ancient Time

Patriarchal clan system was prevailing in th e ancient society of China , and clans played a relatively important role in social life. Family name, as a symbol of clan and consanguinity, was given many cultural meanings and such cul ture had affected the ancient laws greatly. This paper makes an elementary discu ssion on the relationship of traditional culture of family name and the clan and marriage systems in the ancient time as well as the adoption system.
